Merging Entity legal Trustee The Successor shall have agreed with the Trustee to observe the same legal requirements for the recognition of such formed or surviving corporation as a legal entity separate and apart from any of its Affiliates as are applicable to the Merging Entity with respect to its Affiliates.
Merging Entity legal Rating Agency The Merging Entity shall have notified each Rating Agency of such consolidation, merger, transfer or conveyance.
